It is important to remember that hostile work environment sexual harassment arises when verbal or nonverbal conduct in the workplace:

  • Is based on or related to the sexuality or gender of an individual.
  • Is unwelcome or unwanted by the recipient.
  • Is sufficiently severe or pervasive to disrupt the individual's work environment.

While certain behaviors may be deemed inappropriate or unprofessional, they do not necessarily meet the criteria for sexual harassment. However, such conduct may still violate company policies or be deemed unsuitable for the professional setting.
